Terms of Service

Welcome to Briskl.tech ("Briskl", "we", "us"). These Terms of Service ("Terms") govern your access to and use of our website and services. By using our services, you agree to these Terms.
1. Services
We provide hands-on Shopify growth and implementation services, including but not limited to audits, landing/product page builds, full store (re)builds, and product launch packages, as described on our website or custom proposals.
2. Engagement & scope
- Work begins after payment and agreement on scope, milestones, and timeline.
- Client will provide timely access and materials needed to deliver the work.
- One round of reasonable tweaks is included post-delivery unless otherwise agreed.
- Additional changes beyond the agreed scope may require a separate quote.
3. Payments & refunds
- Unless stated otherwise, invoices are due upfront prior to work commencing.
- Payments are processed via third-party providers (e.g., Stripe, Wise, PayPal).
- Due to the nature of done-for-you implementation, fees are generally non-refundable once work has started. If you cancel before work begins, we may refund less any processing fees at our discretion.
4. Access & security
- We strongly prefer Shopify collaborator access. Do not share plaintext passwords.
- The client is responsible for managing internal user access and revocations.
- We will take reasonable steps to protect credentials and assets we access.
5. Intellectual property
- Client owns their brand assets, content, products, and store data.
- Upon full payment, deliverables we create for your store are licensed to you for use on your Shopify store. Underlying tools, methods, or frameworks remain Briskl’s IP.
- You grant us permission to reference the engagement as portfolio or case-study material, excluding confidential information, unless you explicitly opt out in writing.
6. Confidentiality
We will keep your non-public information confidential and use it solely to deliver the services. We may disclose information if required by law or with your consent.
7. Disclaimers
While we apply proven best practices, we do not guarantee specific business outcomes. Results depend on multiple factors (market, product, traffic quality, seasonality, etc.).
8. Limitation of liability
To the maximum extent permitted by law, Briskl will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the services. Our aggregate liability is limited to the amounts you paid us in the 3 months preceding the claim.
9. Governing law
These Terms are governed by the laws of your country or state of residence, unless a different jurisdiction is required by mandatory law. Venue for disputes will be selected reasonably and in good faith.
10. Changes
We may update these Terms from time to time. We will change the "Effective" date above and, where appropriate, provide additional notice.
